
Terms and Conditions
Jetabout North America Inc. doing business
as Islands in the Sun, hereinafter referred to as “Islands in the Sun,” accepts
reservations subject to these Booking Conditions:
1. Validity
Information is valid from January
1, 2006 until March 31, 2007 or until superseded.
Important Notice: All prices reflect a 3% discount for purchases made with
cash/check. There are no discounts for sales made on credit cards.
2. Prices
Prices are quoted in U.S. dollars.
Islands in the Sun reserves the right to change our prices for any reason. All
prices have been calculated based on coach and hotel tariffs and rates of
exchange as of November 18, 2005. Prices will not be changed after full payment
has been received by Islands in the Sun for the final invoice price. Prices do
not include Taxes, and applicable fees unless specified.
3. Deposits
A minimum non-refundable deposit of US$200
per person is due and payable when reservations are initiated. Additional
deposits are required for certain cruises, exclusive island resort hotels, and
non-brochure products. Your travel coordinator will advise you of the required
additional deposit at the time of making your reservation.
4. Final Payment
Final payment must be received by islands
in the Sun at least 45 days prior to departure. For reservations made less than
45 days prior to departure, full and final payment is due at the time of making
the reservation. Failure to make final payment when due will result in the
reservation being automatically canceled and you will be responsible for the
cancellation fees specified in Sections 6 and 9. Payment of any money
constitutes acceptance of all Terms and Conditions as described herein by the
purchaser and passenger.
5. Method of Payment
Islands in the Sun accepts the following
forms of payment: cash, check, money order, Visa, MasterCard, American Express
and Discover cards.
6. Airline
Ticketing/Cancellation
Most airfares used for these vacations are
based on Advance Purchase Excursion Fares, and are subject to applicable
cancellation penalties and the rules and regulations imposed by each airline. If
you cancel your reservation, a cancellation fee will be imposed by the airline
of up to 100% of the airfare. Any deviation from the set itinerary may also
affect the airfare, and you will be responsible for payment of any increase in
the airfare should you change the set itinerary. Islands in the Sun must issue
all international and domestic air tickets for your vacation; otherwise a
service fee of up to US$150 will be added to the vacation price. After the air
ticket is written, any change requiring ticket re-issuance (such as a change in
airline dates, routing, stops, or change of name due to the name provided to
Islands in the Sun not being exactly the same as the name on the passport) will
be assessed a US$100 change fee plus any change and cancellation penalties
charged by the airlines. The airfare excludes Taxes and Fees such as: U.S.
Departure and Arrival Taxes, Customs and Immigration Fee, Inspection Service
Fee, Civil Aviation Security Fee, September 11 Security Fee, Los Angeles P.F.C.
Tax, and International landing and departure taxes. You are responsible for
paying such additional Taxes and Fees.
7. Late Booking Fees
A US$50 fee may be levied on bookings
requested within 21 days prior to departure to cover communication costs and
overnight document delivery fees.
8. Amendments to Confirmed
Bookings
After confirmation has been received there
is a US$50 amendment fee each time an itinerary is revised. No amendments will
be made until a deposit is received. Amendments made after documents have been
issued will incur a US$150 fee to cover courier costs, communication costs and
additional time to coordinate the changes.
9. Cancellation Fees
If you must cancel, please note that
deposits and modification fees are not refundable. Within 45 days of departure
we charge $350 per person plus any fees assessed by hotels, tour companies or
airlines. Separate cancellation fees apply to yacht vacations, cruises, crewed
charters, “Tahiti Aggressor,” Dream Island, Villa Corallina, Pension Mauarii and
Easter Island, and these fees are set out in the appropriate section of the
brochure/website. Additional cancellation fees may apply for Christmas/New Years
period.
We strongly recommend travel insurance to
cover insurable risks.
10. Document Dispatch
Documents will be dispatched at specified
times prior to departure based on when the booking is completed and paid in
full.

11. Refunds & Unused
Services
Refunds for unused accommodations for any
reason, transfers, tours and other services cannot be made unless you provide a
signed statement from the specific hotel, driver or tour operator stating that a
refund is in order. We must receive this statement within 30 days of the tour’s
termination or else the refund request cannot be considered. Under no
circumstances will accommodations and services used be refunded. Unused meals
are not refundable. If flight schedules change, resulting in a lesser number of
included meals, no refund is due. Additional expenses incurred from any changes
made en route are the sole responsibility of the passenger. A refund cannot be
guaranteed for any unused services. All refunds will be charged an
administration fee of $100 per person plus any cancellation fees charged by
ground operators.
12. Passports/Visas
All passengers require a valid passport
and, in some instances, visas. It is the passenger’s responsibility to have a
valid passport and the necessary visas for the countries being visited. Islands
in the Sun accepts no responsibility if you do not have the correct
documentation for your vacation.
13. What Is Not
Included
Items of a personal nature such as
laundry, drinks, telephone and fax charges, visa and passport fees,
vaccinations, meals not specified, gratuities (unless specified), and foreign
and domestic departure taxes.
14. Accommodation
Share twin accommodation is based on two
single beds or one double bed as provided by the hotel. Hotels provide triple
accommodation generally with a twin or double-bedded room and one rollaway bed
at an additional charge. Single room accommodation must be booked by people
wishing to travel alone. Special requests such as non-smoking floors or
king-size beds cannot be guaranteed.
15. Special Requirements
a) You, the passenger, are responsible for
advising your Travel Coordinator or us of any special requirements you may have
and it is your Travel Coordinator’s responsibility to communicate to you any
changes or alterations advised to your Travel Coordinator by Islands in the Sun.
b) It is your responsibility to advise your Travel Coordinator in writing of any
medical conditions that may in any way affect your ability or the ability of any
member of your traveling party to undertake the travel arrangements that you
have purchased. In addition, you must provide to your Travel Coordinator a
letter from your personal physician stating the nature of the medical condition
and certifying that you are physically fit to undertake the travel arrangements
as purchased. It is then your Travel Coordinator's responsibility to provide
Islands in the Sun with copies of the letter and to request in writing that
Islands in the Sun arrange any special requirements considered necessary.
Without such written notice, Islands in the Sun accepts no responsibility for
special requirements not provided. Some products in this brochure may require
you to undertake medical examinations. You may also be required to show these
documents to certain suppliers.
16. Responsibility
Islands in the Sun purchases
transportation, hotel accommodations, restaurant services, and other services
from various independent suppliers that are not subject to its control.
ISLANDS IN THE SUN CANNOT, THEREFORE, BE
LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, OR ANY OTHER SPECIAL,
CONSEQUENTIAL OR INCIDENTAL DAMAGES that may occur due to (a) intentional,
wrongful, negligent, or arbitrary acts or omissions on the part of a supplier,
its employees and others not under the direct control of Islands in the Sun, or
(b) defects or failures of any aircraft, vessel, automotive vehicle or other
equipment or instrumentality under the control of independent suppliers. In
addition, Islands in the Sun cannot be liable for delays in departure or
interruption of your vacation arrangements caused by weather conditions,
technical problems of any aircraft, vessel, automotive vehicle or other
equipment or instrumentality, strikes, war, terrorist activity, civil commotion,
or any causes beyond the control of Islands in the Sun. In no event will Islands
in the Sun be responsible for incidental, consequential or special or incidental
damage or loss suffered by any person. Islands in the Sun’s maximum liability,
for any reason whatsoever, will be limited to the amount paid to Islands in the
Sun for its services. In issuing tickets and coupons for transportation of the
purchaser by any means, and making arrangements for hotel or other
accommodation, Islands in the Sun is not acting as principal but only as agent
for the companies, corporations or persons providing or offering the means of
transportation and accommodation. To the extent Islands in the Sun shall not be
acting as an agent, as stated above, it shall be deemed to be acting as an agent
of the purchasers in arranging or booking transportation and accommodation.
Airlines and other transportation providers (e.g., motor coach operators) are
not liable for any detention, delays, loss, damage, sickness or injury, however
or by whomever caused, during the time passengers are not on board their planes
or conveyances. The contract of carriage used by such transportation providers
when issued shall constitute the sole contract between the transportation
providers and the purchaser of these vacation arrangements.
17. Travel Insurance and
Waiver
Islands in the Sun strongly recommends
that you purchase travel insurance providing coverage for loss of deposit,
cancellation fees, medical expenses, lost baggage and other potential
travel-related losses under certain circumstances. Such insurance must be
purchased at the time of your initial travel reservation, and paid for with your
deposit. The scope of coverage is subject to the terms and conditions of the
insurance policy.
The
unexpected occurs without warning, sometimes forcing you to cancel or interrupt
your trip. Without insurance, you stand to lose your entire vacation investment
if you must cancel, or be stuck with paying for costly last-minute arrangements
with no recourse for reimbursement.
We strongly recommend that you purchase
travel insurance to provide peace of mind while you travel. The comprehensive
travel insurance plan we offer answers these concerns, providing coverage for a
wide range of last-minute unexpected occurrences. Along with trip cancellation
and interruption coverage, the plan also covers travel delays; lost, damaged or
delayed baggage; medical expenses; and emergency medical evacuation. The
comprehensive insurance plan includes these additional travel services available
24 hours a day: Pre-travel advice, emergency cash transfers, medical and legal
referrals, lost ticket and passport assistance and emergency prescription refill
assistance. Complete details of your coverage and services are available in the
Certificate of Insurance upon request.
Our “No Worries Waiver” covers
cancellation fees NOT protected by Travel Insurance, for cancellations up to 72
hours prior to departure. Certain exclusions apply. Ask for details.
18. Maps and Photographs
Maps shown within this website are for
general information only and may not necessarily reflect actual routings and
services provided. The hotel photographs may not necessarily reflect the
standard of any room purchased.
19. Important Note
We are required under California law to
advise you of the following: For passengers located in California only, in the
event of Islands in the Sun’s default, you may be eligible for a refund of up to
US$15,000 from the California Travel Consumer Restitution Fund. If you were
located in California at the time of your purchase, you have a right to make a
claim against the fund for a refund of any money paid to Islands in the Sun that
is due because of Islands in the Sun’s bankruptcy, insolvency, cessation of
operations, or material failure to provide the transportation or travel services
sold. The claim must be filed within six months after the completion date of
your travel.

“Registration as a seller of travel does
not constitute approval by the State of California.” The following and the
conditions on our brochures are our conditions upon which the contract between
us, the seller of travel services, and the passengers may be canceled. Upon
cancellation of the transportation or travel services, where you, the customer,
are not at fault and have not canceled in violation of the terms and conditions,
if any, of the contract for transportation or travel services, all sums paid to
Islands in the Sun for services not received by you will be promptly refunded by
Islands in the Sun to you unless you otherwise advise Islands in the Sun in
writing. California law requires that the following statement be made to
customers located outside of California at the time of purchase: “This
transaction is not covered by the California Travel Consumer Restitution Fund.
You are not eligible to file a claim against that Fund in the event of Islands
in the Sun’s default.”

Reservations
Please reserve your vacation with your professional travel agent/coordinator.
Late Reservations
There is no surcharge for late bookings, provided that full payment has been
received and documents can be delivered prior to departure. Express mail
delivery is additional.
Deposits & Payments
A non-refundable deposit of $200 per person is required at the time of booking
to hold your reservation. Specific deposit and payment requirements apply to
itineraries including Club Med, and some of our cruise programs, and this
information will be given on request at the time of booking. Final payment is
due 45 days prior to departure. Full payment is due at the time of booking for
reservations made within 45 days of the date of departure.
Cancellations &
Modifications
A service charge of $50 per booking will apply for each change made after the
initial booking request has been confirmed. For cancellations received within 30
days of departure, airlines and other vendors may assess cancellation fees,
which will be passed on to you. Once travel has commenced, any changes or
cancellation will be at your own expense. Special cancellation and modification
policies apply for itineraries including Club Med or cruises, and this
information will be given on request at the time of booking.
Valuable Insurance
Protection
An optional travel insurance plan offered by Trip Mate Insurance Agency, Inc. is
strongly recommended and is available with all of Tahiti Legends' tour packages.
Protection of Funds
Legends is registered as a seller of travel with the Attorney General of the
State of California pursuant to Section 17550 of the California Business and
Professions Code, under registration #1005294-40. Registration as a seller of
travel does not constitute approval by the State of California. All customers'
deposits and payments are secured in Tahiti Legends' trust account.
Documents Required
U.S. and Canadian citizens must have a valid passport valid for six months from
travel date. Citizens of outher countries should consult the French Consulate.
It is solely the passenger's responsibility to ensure that all documents needed
are complete and current. International tickets cannot be issued until we
receive a copy of the name page of the passenger's passport.
Pricing
All prices quoted by Tahiti Legends are in U.S. dollars and include costs
associated with planning, communication and documentation. According to industry
standards, package prices are not subject to an itemization of costs.
Included Features
Hotel accommodations are based on two people sharing a double-bedded room or
bungalow with private facilities. The currently known Tahitian government room
tax and VAT are included. All itineraries include inter-island transportation,
round trip hotel transfers, and baggage handling. Sightseeing and meals are
included only as specified for each itinerary. Hotels offer complimentary
equipment and activities subject to availability. Tahiti Legends reserves the
right to change the itinerary sequence and properties when necessary.
Air-inclusive packages include airline fuel surcharges. Air
Tahiti Nui fuel surcharge: from Los Angeles, approximately $90 per person ; and
from New York, approximately $110 per person. Air France fuel surcharge: from
Los Angeles, approximately $80 per person. Fuel surcharges are subject to
change.
Modification & Cancellation Waiver
For a Waiver fee of $65 per adult (18 years or older, accompanying children
are free) you may modify or cancel, prior to departure, any part of your booking
without paying the normally assessed modification and cancellation charges. The
Waiver must be purchased at time of booking to avoid cancellation, modification
and express mail fees and to guarantee you full refund on your vacation should
you cancel anytime up to 24 hours prior to your departure.
Tahiti Legends Waiver covers tours and activities purchased from Tahiti Legends
prior to departure. The Waiver must be purchased by all adults (18 years or
older) included in the reservation.
The Waiver is non-transferable (no name changes) and non-refundable. The Waiver
is not insurance. The Waiver does not cover cruises, fishing or yacht charters,
optional tours, lost or stolen airline tickets, changes in occupancy for
accommodations or services, certain special discounted airfare or tariffs with
restrictive or non-refundable cancellation and revision policies; increases
resulting from imposition or increase of tax or surcharges. No-show penalties
are not covered by this Waiver.
Tahiti Legends reserves the right not to sell the Waiver when highly restrictive
fares or hotel policies have severe penalties, and to suspend offering and
selling the Modification and Cancellation Waiver at any time.
Not Included
Meals (except where indicated), beverages, laundry, excess baggage charges, and
any items of a personal nature, including the cost of passports and visas, are
not included. U.S. Departure Tax and U.S. Federal and Agricultural Inspection
Fees (from Los Angeles $65 and from New York $65) are not included and are
subject to change.
Accommodation city tax of 150 CFP (approximately $1.55) per
person, per night, is not included.
Air Fares
The air fare from Los Angeles to Tahiti used in the tour packages featured in
this brochure and for customized vacations is an economy class fare. A high
season supplement applies. APEX rules require that we issue your ticket at least
14 days prior to departure and that you stay in Tahiti no more than 30 days.
Severe penalties apply if you cancel after the ticketing deadline date. All
travel is based on Tahiti Legends providing the air tickets. Should travel be on
an airline other than those specified in the package itineraries, the price may
increase. Airfares are subject to change without notice.
Seasonal Air and Land
Supplements
Seasonalities vary widely for hotel rates and airfares. All details are not
shown. Please ask at time of booking for applicable charges.
Refunds
Tahiti Legends will process refunds for unused accommodations, transfers, tours
or other services, provided that requests are accompanied by a signed statement
from the service supplier stating that a refund is in order. Refund requests
must be received within 30 days of a tour's termination. No refund will be made
for accommodations or services used, or for unused days at Club Med, cruises,
and yacht charters. Unused meals are not refundable.
Terms & Conditions
The payment of the deposit, or any partial or full payment for a reservation,
shall constitute consent to all provisions stated in this brochure/website.
Responsibility Clause
Vacation components are contracted by CDM Travel Service, dba Tahiti Legends,
19891 Beach Blvd #107 - Huntington Beach - California 92648 - USA. Tahiti
Legends, its agents and employees, act only as agents for the passenger in
regard to travel by road, air, sea or by mode of transportation or local
conveyance, and assumes no liability for personal injury, property damage, loss,
accident, delay or irregularity incurred by any person or tour participant
arising out of the negligence of any direct or supplemental air carrier, hotel
or person engaged in conveying the passenger, providing rental cars, or
rendering any of the services or accommodations being offered in these tours;
nor shall Tahiti Legends be responsible for any injuries, death, damages, loss
or delay in any means of transportation or by reason of any event beyond the
actual control of Tahiti Legends. Any such losses or expenses must be borne by
the passenger as tour rates provide for arrangements only as stated in the final
itinerary. The right is reserved to substitute hotels of similar category or
change schedules without prior notice should circumstances so require. In the
event of a change in the itinerary necessitated by factors or conditions beyond
the actual control of Tahiti Legends, such as strikes, political and social
unrest, labor problems, climatic aberrations, or any act of God, no refund can
be made nor will credit be given, provided that in the event of such change
Tahiti Legends shall provide accommodations and services of comparable quality
and standards as set forth in this brochure. The right is reserved to decline to
accept or to retain any person as a member of a trip, or to cancel a trip in all
or part due to circumstances beyond the control of Tahiti Legends. Prices quoted
in the brochure are in U.S. dollars and are based upon current tarifs and
exchange rates known as of December 1, 2005, and are subject to adjustment
without prior notification in the event of changes therein. Any such changes
will be passed on to the passenger in all other cases. However, once full
payment has been received, quoted prices are guaranteed. Passengers electing to
take advantage of sporting equipment offered by the ships, yachts, Club Med or
other hotels, do so at their own risk. Tahiti Legends expressly discourages the
use of motor scooters or similar powered cycles. Baggage is at owner's risk
entirely. The airlines concerned, and their agents and affiliates, are not to be
held responsible for any act, omission or event during the time passengers are
not on board their aircraft. The passenger ticket in use by said airlines, when
issued, shall constitute the sole contract between the airlines and purchaser of
these tickets and/or passenger. The schedules contained herein are subject to
change without notice.
